Our class action attorneys most recently successfully resolved claims for violations of the Telephone Consumer Protection Act, also known as the TCPA, which prohibits unauthorized calls and texts to your cellular phone if the caller uses predictive dialers or prerecorded messages. The TCPA also prohibits junk faxes. The statute acknowledges that intrusive and abusive telemarketers increase consumer costs, are harassing, and invade privacy. Thus, the TCPA entitles people who experience these prohibited marketing tactics to recover statutory penalties for each violation. In addition to prohibitions on junk faxes and do-not-call violations, the TCPA expressly prohibits automated, artificial, or prerecorded calls or text messages “to any telephone number assigned to a paging service, cellular telephone service, specialized mobile radio service, or other common carrier service, or any service for which the called party is charged.” 47 U.S.C. 227(b)(1)(A)(iii).
